The driver (or biker) commits himself to carry the items specified in the pick-up section, pursuant to the law of the province of origin and under the terms and restrictions indicated in the rate at the expedition date, and in the province of Quebec, as referred to in the civil code.
Delays
Unless there is a written agreement, the driver will not be responsible for direct or indirect damages resulting from any delay of delivery, no matter what is the reason of the delay.
Responsibility
The driver will not be responsible for any losses, damages in transport or other damages or delays, in the following cases:
- Fortuitous events
- Strikes
- Operation of law
- Defects in the merchandise shipped
- Defects created by the shipper or by the owner of the merchandise shipped
- Nuclear reaction or contamination by radiation or radioactivity.
Declared Value of Shipment
For any loss, damage or failure, the driver’s responsibility for one shipment is limited to $1.50/lb and/or $50, except in the following cases:
- Contradictory agreement between the shipper and the driver and if the name of the shipper appears on the rider of the driver’s cargo insurance.
- Superior value declared in the bill of lading, an additional charge of $3 will be applied per each $100 or part of $100. The driver will not compelled to accept any shipment in excess of $500 unless an agreement was made to that effect.
Notice of loss or damage
A notice of loss or damage should be sent to the driver’s regional office or main office within 24 hours and, in writing, within 30 days of the acceptance of the shipment.
NOTE: The driver will not be held responsible for any loss or damage incurred if he has not received a written notice within 30 days of the acceptance of shipment.
For expeditions to or from a destination within the province of Quebec, the terms and conditions specified in the RT-200 form will apply, as promulgated by Transports Québec. |
